Minglr Raffle Rules – Web Summit Lisbon, November 11-14, 2024

1. Organizer:The raffle organizer is Minglr, officially attending Web Summit Lisbon from November 11-14, 2024.

2. Campaign Period:The campaign runs exclusively during the Web Summit event (November 11-14, 2024).

3. Eligibility: Participation is open to individuals who meet the following criteria:

* Attend Web Summit 2024.

* This Campaign is open to any individual who is over 18 years of age and has full legal capacity, or to any legal entity.

* Follow the @minglrapp Instagram account.

* Post a public Instagram Story tagging @minglrapp and @WebSummit.

4. Prizes:

* All participants who meet the criteria above receive a free one-year subscription to Minglr:

   * iOS Users: Subscription will be activated immediately.

   * Android Users: Subscription will be available starting in December 2024, with the app’s release on Google Play.

* November 14, 2024, Raffle Draw:

   * iOS Prize: One iPhone 16, awarded to a randomly selected iOS participant who:

       * Has the Minglr app installed.

       * Has an active Minglr account.

       * Posts an Instagram Story with @minglrapp and @WebSummit tags on November 14, 2024.

   * Android Prize: One CMF by Nothing phone and CMF by Nothing earbuds, awarded to a randomly selected Android participant who posts an Instagram Story with @minglrapp and @WebSummit tags on November 14, 2024.

5. Draw Mechanism:

* Participant Identification: Minglr will monitor tags @minglrapp and @WebSummit from the official Minglr Instagram account to generate the complete list of eligible participants.

* Categorizing iOS vs. Android Participants: After identifying participants, each will receive a direct message to confirm their platform (iOS or Android).

* Selection Method:

   * Winners will be chosen using a digital random selection tool (e.g., random number generator).

   * Two separate draws will be held: one for iOS users and one for Android users.

6. Winner Announcement:

* Winners will be contacted via direct message on Instagram to confirm identity and eligibility for claiming the prize.

* Winners will be publicly announced on the @minglrapp Instagram account on November 14, 2024.

7. Limitation of Liability

* Minglr is entitled to take all necessary measures in case of any attempt to defraud the system, abuse, or other actions that could affect the fair conduct of this campaign, as well as the image of Minglr, its partners, or affiliates.

* Minglr bears no responsibility and cannot be held liable for any damages resulting from the fault of any participant, including but not limited to negligence, fraud, or any actions by participants in connection with the registration procedures for the campaign or the use of the Minglr platform.

* Minlgr will not be responsible for any delays or technical issues with third-party platforms (e.g., Instagram) that could prevent proper participation in the campaign, as these are outside the direct control of Minglr.

8. Campaign Regulations

* The Campaign Regulations are available to any interested person or requester, free of charge, throughout the duration of the Campaign:

on the Minglr website, on the dedicated page for this Campaign;
on the Minglr app.

* The Organizer reserves the right to modify and/or supplement the Regulations, after prior notice to the participants regarding any changes to its provisions, at least 24 hours before the entry into force of such changes. Any amendments/additions to these Regulations will be included in additional documents that will be made available to the public. The updated Regulations will be communicated to the public by publishing the modifying documents on the Minglr website, on the Campaign’s dedicated page, at least 24 hours before the amendments take effect.

* At the Organizer’s discretion, the Campaign may be publicized for the purpose of informing the public, including through advertising and/or informational materials.

* By registering for this Campaign, participants declare and acknowledge that they have read and understood the provisions of the Regulations and that they accept the terms and conditions of this Regulation. Participants also understand that, for the purpose of the Campaign, their personal data will be processed in accordance with the Regulations. Participants agree to comply with and adhere to all terms, conditions, and provisions of these Regulations.

9. Data Processing Policy for the Campaign

* The organizer of this Campaign, MINGLR S.R.L., a Romanian legal entity, with its registered office in Bucharest, Sector 1, Drumul Nisiposa, no. 46-52, Block A, registered with the Bucharest Trade Registry under no. J40/5204/2023, with fiscal identification code no. 47828507, as the data controller (“Controller”), processes the personal data of individuals who register for the Campaign, as well as personal data of other individuals, as may be necessary in the context of validating the participants in the Campaign, in full compliance with the General Data Protection Regulation (EU) 679/2016 (GDPR), applicable data protection laws, and the provisions of this section of the present Regulation, directly.

Categories of Data Subjects

The data subjects are the individuals who register for the Campaign, as per the Regulations (even if it is later determined that these individuals do not meet the eligibility criteria established by the Regulations).

Purposes of Data Processing and Legal Basis

For the purpose of organizing the Campaign, the Controller processes or may process personal data for each of the following purposes:

(i) Performance of the contract between the participant and the Organizer.


The personal data of the individuals who register are processed based on the contractual relationship established by their registration for the Campaign, subject to acceptance of the Regulations, in order to carry out the Campaign, provide the specific benefits of the Campaign, and resolve any complaints raised by the individuals who registered or other persons regarding the conduct of the Campaign.

(ii) Compliance with legal obligations by the Organizer.


The data of individuals who register, or of other individuals whose data is processed in the context of validating and providing Campaign benefits, are processed in order to comply with the legal obligations incumbent on the Organizer (such as financial, accounting, tax, and archiving obligations).

Data may also be processed by the Organizer in the context of addressing requests concerning the exercise of data subjects’ rights regarding the processing of personal data, based on the legal obligations of the Organizer under specific data protection legislation.

(iii) Legitimate interest of the Controller.


The Organizer may process data for the purpose of resolving complaints other than those mentioned above in points (i) and (ii), raised by individuals who consider themselves harmed, based on the legitimate interest of the Organizer.


Additionally, the Organizer may process personal data for the defense of its rights, the enforcement of the provisions of the Regulations, and/or the initiation of legal or administrative procedures, including for the investigation of potential violations, as well as conducting various reports, analyses, and statistical studies regarding the campaigns organized and their success, based on the legitimate interest of the Organizer.

(iv) Consent of the data subject.


The Organizer will process the data provided by individuals registering through the optional message provided in the contact form, based on the consent given by these individuals.
Any withdrawal of consent will have an effect for the future and will not affect the legality of processing carried out prior to the withdrawal of consent.

Categories of Personal Data Processed

The primary categories of personal data processed are collected directly from the data subjects and include name, surname, email address, phone number, and any other data identifiable within the documents required for the validation and provision of the specific benefit of the Campaign.

Duration of Processing and Storage of Personal Data

Personal data will be processed for the duration necessary to carry out the Campaign and thereafter, in order to comply with applicable legal obligations, including but not limited to financial, accounting, tax, and archiving legislation.

Rights of Data Subjects

As data subjects of the processing activities, you have the following rights under the applicable laws in the field of personal data protection:

Right of access to data: You may request and receive confirmation from the Organizer regarding the details of the data processing (what data we process, for what purpose, where and how long we store it, who has access to it, etc.);
Right to rectification: If the data we use is inaccurate or incomplete, you may update it by making a request (for example: if you changed your phone number or email address, you can contact us to update this information). This right can be exercised along with the restriction or objection rights;
Right to erasure of data: You may request that part or all of the data we hold about you be erased.
Important! We may not be able to fulfill the request in all cases (for example, if the law requires us to keep data for a certain period, or if the data is needed for a legitimate interest such as the defense of a right in court);
Right to restriction of processing: You can request that we stop processing your data but still store it until we resolve another request you’ve made, such as:
o request for rectification of data;
o objection to the erasure of data in case of unlawful processing;
o request for providing certain data to defend a right;
o objection to processing – see below.
Right to data portability: You may request that the data you have provided be communicated to you in a commonly used, machine-readable format. You may also request that your data be sent to another controller.


Important! We are only obliged to fulfill the request for data processed previously based on your consent or for the performance of a contract with us and only if the data is processed by automated means.

Right to object: You may object at any time, for legitimate reasons related to your particular situation, to the processing of data concerning you, in accordance with applicable legal provisions.
Important! The law only obliges us to comply with objections regarding data processing for direct marketing purposes (for example, if you receive promotional emails from us, you can request to unsubscribe). In other cases, we are required to analyze each specific situation before making a final decision. Therefore, please explain why you object to processing when you submit the request.
Right not to be subject to automated decision-making: As a rule, you have the right not to be subject to an automated decision that produces legal effects or similarly significantly affects you (e.g., automatic refusal of a contract based on automated data processing).
Right to withdraw consent: If we process data based on your consent, you may withdraw it at any time.


Important! Withdrawal of consent will only affect future processing. Processing performed for other purposes, such as fulfilling a contract, will not be affected by the withdrawal.

Right to lodge a complaint with the competent supervisory authority: If you are dissatisfied, you may address the National Supervisory Authority for Personal Data Processing or competent courts.

10. Complaints and Disputes

* Any complaints regarding the organization of the Campaign, the validation of registrations, and the awarding of the Campaign’s benefits will be considered if they are received by the Organizer at: email hi@minglr.eu, within the legal deadline for submitting such complaints.

*Any disputes between the Organizer and participants regarding any aspect related to the Campaign will be resolved amicably, and if this is not possible, the disputes will be settled by the competent Romanian courts.

*This Regulation and the entire Campaign are governed by Romanian law.

11. Miscellaneus

* The benefits not awarded within the Campaign will remain in the possession of the Organizer, who may freely dispose of them in any manner they deem necessary or appropriate to their interests.

* If any provision of this Regulation is declared null and void, the remaining provisions shall remain valid and effective to the extent that they can produce legal effects even in the absence of the conditions declared null. To the extent possible, the invalid provisions will be replaced with another reasonable, legally valid regulation that corresponds as closely as possible to the purpose of the invalid provisions.
